Mongolians can now apply for US visa for seasonal agricultural workers
The Secretary of Homeland Security determined that Mongolia should be designated as an eligible H-2A and H-2B country because it now meets the standards set out in the regulation.
The United States Secretary of Homeland Security has approved Mongolia for H-2A and H-2B Nonimmigrant Worker Programs which allow other nationals to fill temporary agricultural jobs and temporary or seasonal jobs in the USA when there is a shortage of workers. This is the first time Mongolia has been included in the Identification of Foreign Countries Whose Nationals Are Eligible to Participate in the H-2A and H-2B Nonimmigrant Worker Programs along with 81 other countries. The notice will be effective until the next renewal on January 18, 2019. Mongolia is no longer listed as “At Risk of Non-Compliance” according to ICE’s (Immigration and Customs Enforcement) year-end assessment of foreign countries that cooperate in accepting back their nationals that have been deported from the USA, and has demonstrated increased cooperation with the USA regarding the return of their nationals with final orders of removal. The Secretary of Homeland Security determined, with the concurrence of the Secretary of State, that Mongolia should be designated as an eligible H-2A and H-2B country because it now meets the standards set out in the regulation. An H-2A visa allows US employers to bring foreign nationals to the USA to fill temporary agricultural jobs for which US workers are not available. An H-2A nonimmigrant classification applies to those who seek to perform agricultural labor or services of a temporary or seasonal nature in the USA on a temporary basis. On the other hand, an H-2B visa is required if the applicants are going to the USA to perform a job which is temporary or seasonal in nature and for which there is a shortage of US workers.
